தமிழ்நாட்டில் நில அபகரிப்பு-Land grab in Tamil Nadu

தமிழ்நாட்டில் உள்ள நில அபகரிப்பு சிறப்பு நீதிமன்றங்கள் செயல்படுகின்றனவா என்பது குறித்து பதிலளிக்க சென்னை உயர்நீதிமன்ற பதிவாளருக்கு உச்ச நீதிமன்றம் உத்தரவிட்டுள்ளது.

 

நில அபகரிப்பு புகார்களை விசாரிப்பதற்காக தனி பிரிவை உருவாக்கிய தமிழ்நாடு அரசு, அதுகுறித்த வழக்குகளை விசாரிக்க 2011ஆம் ஆண்டில் சிறப்பு நீதிமன்றங்களை அமைத்தது. ஆனால், அதை எதிர்த்து தொடரப்பட்ட வழக்கு ஒன்றில், தமிழ்நாடு அரசின் உத்தரவை சென்னை உயர்நீதிமன்றம் ரத்து செய்தது. 

அந்த உத்தரவை எதிர்த்து தமிழ்நாடு அரசு உச்ச நீதிமன்றத்தில் மேல்முறையீடு செய்த நிலையில், நில அபகரிப்பு சிறப்பு பிரிவு மற்றும் சிறப்பு நீதிமன்றங்கள் உருவாக்கிய அரசின் உத்தரவுகள் அங்கீகரிக்கப்பட்டன. அதனைத் தொடர்ந்து நில அபகரிப்பு நீதிமன்றங்கள் செயல்படவும் அனுமதி அளித்து உச்ச நீதிமன்றம் தீர்ப்பு வழங்கியது.

 

இந்நிலையில், ஈரோட்டைச் சேர்ந்த முத்துலட்சுமி என்பவர் தொடர்ந்த வழக்கு, உச்ச நீதிமன்ற நீதிபதிகள் சுபாஷ் ரெட்டி மற்றும் ஹரிஷிகேஷ் ராய் முன் விசாரிக்கப்பட்டது. 

அதில், தமிழ்நாட்டில் அமைக்கப்பட்ட நில அபகரிப்பு சிறப்பு நீதிமன்றங்கள் செயல்படுகின்றனவா, இல்லையா என வினவிய நீதிபதிகள், இதுதொடர்பாக சென்னை உயர் நீதிமன்ற பதிவாளர் விரிவான அறிக்கை தாக்கல் செய்ய உத்தரவிட்டு வழக்கை ஒத்திவைத்தனர்.

The Supreme Court has directed the Registrar of the Chennai High Court to respond as to whether special courts are functioning for land grabbing in Tamil Nadu.

 

The Government of Tamil Nadu has set up a separate unit to hear land grabbing complaints and set up special courts in 2011 to hear such cases. However, in one of the cases against it, the Chennai High Court quashed the order of the Tamil Nadu government.

The Government of Tamil Nadu appealed to the Supreme Court against the order, which upheld the orders issued by the Special Land Acquisition Division and the Special Courts. The Supreme Court subsequently allowed the land grabbing courts to operate.

In this context, the case of Muthulakshmi from Erode was heard before Supreme Court Justices Subhash Reddy and Harishikesh Roy.

In it, the judges questioned whether the land grabbing special courts set up in Tamil Nadu were functioning or not and ordered the Registrar of the Chennai High Court to file a detailed report in this regard and adjourned the case.
