வெளிநாட்டினரை கண்காணிக்க தனி பிரிவு -Separate unit to monitor foreigners

இந்தியாவுக்கு வருகை தரும் வெளிநாட்டினரின் நடமாட்டத்தை கண்காணிக்க மாவட்ட அளவில் செயல்படும் தனி பிரிவை ஏற்படுத்த தமிழக டிஜிபி-க்கு சென்னை உயர் நீதிமன்றம் உத்தரவிட்டுள்ளது.

தொழில், வேலைவாய்ப்பு, சுற்றுலா உள்ளிட்ட காரணங்களுக்காக இந்தியா வரும் இலங்கை, நைஜீரியா, சீனா, ஈரான், பங்களாதேஷ் உள்ளிட்ட வெளிநாடுகளைச் சேர்ந்த பலர், விசா காலம் முடிந்தும் இந்தியாவிலேயே தங்கியிருந்து குற்றச்செயல்களில் ஈடுபட்டதாக கைது செய்யப்பட்டுள்ளனர். இதுபோன்ற வழக்குகளில் தொடர்புடைய சுரேஷ் ராஜ் உள்ளிட்ட பல வெளி நாட்டினர், ஜாமீன் கோரியும், முன் ஜாமீன் கோரியும் சென்னை உயர் நீதிமன்றத்தில் மனுக்கள் தாக்கல் செய்திருந்தனர்.

இந்த வழக்கில் உயர்நீதிமன்றம் பிறப்பித்த உத்தரவின் அடிப்படையில், சென்னை, திருச்சி, மதுரை, கோவை உள்ளிட்ட நகரங்களில் மட்டும் 13 ஆயிரத்து 289 பேர் சட்டவிரோதமாக தங்கி இருப்பதாக டிஜிபி அறிக்கை தாக்கல் செய்திருந்தார். இதை பதிவு செய்த நீதிபதி தண்டபாணி, பல வெளிநாட்டினர், இந்தியாவில் சட்டவிரோதமாக தங்கி குற்றச் செயல்களில் ஈடுபடுவதாகவும், இது நாட்டின் பாதுகாப்புக்கு அச்சுறுத்தலை ஏற்படுத்துவதால், இதை தடுக்க சட்டம் இயற்ற வேண்டும் என உத்தரவிட்டுள்ளார்.

விசா காலம் முடிந்த வெளிநாட்டினரை உடனடியாக அவர்களின் சொந்த நாடுகளுக்கு அனுப்பி வைக்க மத்திய அரசு விதிகளை வகுத்துள்ளதாகவும், அவற்றை மாநில அரசுகள் பின்பற்றி நடவடிக்கைகளை எடுக்க வேண்டும் என நீதிபதி வலியுறுத்தியுள்ளார். விசா காலம் முடிவடைந்து தங்கியிருக்கும் பலர் போலி ஆவணங்கள் மூலமாக இந்திய அடையாள அட்டைகளை பெற்றுள்ளதாகவும் வேதனை தெரிவித்த நீதிபதி, வெளிநாட்டவர்களை கண்காணிப்பதற்கு மாவட்ட அளவில் தனி பிரிவை ஏற்படுத்த வேண்டும் என டிஜிபிக்கு உத்தரவிட்டுள்ளார்.

இந்தியா வரும் வெளிநாட்டினரின் பாஸ்போர்ட் விசா உள்ளிட்ட தகவல்களை பதிவு அலுவலகங்கள், மாநில காவல் துறைக்கு வழங்க வேண்டும் எனவும், தமிழகம் முழுவதும் விசா காலம் முடிவடைந்து சட்டவிரோதமாக தங்கி இருப்பவர்களை அவர்கள் சொந்த நாடுகளுக்கு அனுப்ப நடவடிக்கை எடுக்க வேண்டுமெனவும் உத்தரவிட்டுள்ளார்.

The Chennai High Court has ordered the Tamil Nadu DGP to set up a separate unit at the district level to monitor the movement of foreigners visiting India.

Many foreigners, including those from Sri Lanka, Nigeria, China, Iran and Bangladesh, who come to India for work, employment or tourism, have been arrested for staying in India after their visas expire. Several foreigners, including Suresh Raj, involved in such cases, had filed petitions in the Chennai High Court seeking bail and pre-bail.

Based on the order issued by the High Court in this case, the DGP had filed a report that 13 thousand 289 persons were staying illegally in cities including Chennai, Trichy, Madurai and Coimbatore alone. Judge Dantapani, who recorded the case, ruled that many foreigners were staying in India illegally and engaging in criminal activities, and that legislation should be enacted to prevent this as it poses a threat to the country's security.

The judge stressed that the federal government has laid down rules for the immediate repatriation of foreigners whose visas have expired, and that state governments must follow suit. The judge also lamented that many of those whose visas had expired had obtained Indian identity cards through forged documents and ordered the DGP to set up a separate unit at the district level to monitor foreigners.

He also directed the registration offices to provide the passport and visa details of foreigners coming to India to the state police and to take steps to repatriate those who are staying illegally in Tamil Nadu after their visa expires.
