"விளையாட்டு வீராங்கனைக்கு அரசு வேலை" உயர்நீதிமன்றத்தில் தொடரப்பட்ட வழக்கு தள்ளுபடி-Dismissal of the case filed in the High Court on "Government Job for Athlete"

கபடி விளையாட்டில் நான்கு சர்வதேச தங்கப்பதக்கங்களை வென்ற வீராங்கனைக்கு அரசு வேலை கோரிய வழக்கில் பொதுநலன் இல்லை எனக் கூறி தமிழ்நாடு விளையாட்டு வீரர் சங்கம் தொடர்ந்த வழக்கை தள்ளுபடி செய்து சென்னை உயர் நீதிமன்றம் உத்தரவிட்டுள்ளது.

காமென்வெல்த், ஏசியன் கேம்ஸ் போன்ற சர்வதேச விளையாட்டு போட்டிகளில், இந்தியாவுக்காக விளையாடி தங்கப்பதக்கம் பெற்றுக் கொடுத்த கவிதா என்ற வீராங்கனையை அங்கீகரிக்கும் வகையில் அவருக்கு அரசு வேலைவாய்ப்பு வழங்க கோரிய விண்ணப்பத்தை பரிசீலிக்கும்படி தமிழக அரசுக்கு உத்தரவிடக் கோரி தமிழ்நாடு விளையாட்டு வீரர்கள் சங்கம் சார்பில் பொதுநல வழக்கு தொடரப்பட்டிருந்தது.

இந்த வழக்கு பொறுப்பு தலைமை நீதிபதி முனீஷ்வர்நாத் பண்டாரி மற்றும் நீதிபதி ஆதிகேசவலு அடங்கிய அமர்வில் விசாரணைக்கு வந்த போது, இந்திய கபடி அணி கேப்டனாக இருந்த கவிதா ஆயுதப்படை பிரிவில் சேர்ந்தார். அவருக்கு உதவி ஆய்வாளராக பதவி உயர்வு மறுக்கப்பட்ட நிலையில், தொடர்ந்து பணிக்கு வரவில்லை எனக் கூறி பணி நீக்கம் செய்யப்பட்டதாகவும், அதை எதிர்த்த வழக்கு உயர் நீதிமன்றத்தில் நிலுவையில் உள்ளதாகவும் மனுதாரர் சங்கம் தரப்பில் தெரிவிக்கப்பட்டது.

தேர்வு மூலம் பெற்ற பணியில் இருந்து நீக்கப்பட்ட நிலையில் அவர் வறுமையில் வாடுவதால், பிற மாநிலங்களைப் போல அவருக்கு அரசு வேலை வழங்க கோரிய விண்ணப்பத்தை பரிசீலிக்க உத்தரவிட வேண்டும் எனவும் மனுதாரர் சங்கம் தரப்பில் கோரப்பட்டது.

இந்த வாதத்தை ஏற்க மறுத்த நீதிபதிகள், ஏற்கனவே அரசு வேலை வழங்கப்பட்ட நிலையில் அவருக்கு அங்கீகாரம் வழங்கவில்லை எனக் கூற முடியாது எனவும், தனி நபருக்காக தாக்கல் செய்யப்பட்டுள்ள இந்த பொது நல மனு விசாரணைக்கு உகந்ததல்ல என்றும் கூறி வழக்கை தள்ளுபடி செய்து உத்தரவிட்டனர்.

The Chennai High Court has dismissed the case filed by the Tamil Nadu Athletes' Association (TAA) alleging that there was no public interest in the case of a government job seeker who won four international gold medals in kabaddi.

A welfare case has been filed on behalf of the Tamil Nadu Athletes' Association seeking an order from the Government of Tamil Nadu to consider her application for government employment in recognition of Kavitha, who won gold medals for India at international sports such as the Commonwealth and the Asian Games.

Kavita, who was the captain of the Indian Kabaddi team, joined the Armed Forces when the case came up for hearing in a session comprising Chief Justice Munishwarnath Bandari and Justice Adikesavalu. He was denied promotion to the post of Assistant Inspector, but was dismissed on the ground that he had not returned to work and a case against him was pending in the High Court.

The petitioners' association also sought an order directing it to consider his application for government employment, as in other states, as he was living in poverty after being removed from the job he had obtained through selection.

Refusing to accept this argument, the judges dismissed the case, saying that it was not possible to say that he had not been recognized for having already been offered a government job and that the public interest litigation filed for the individual was not amenable to trial.
