"ஜெயலலிதாவின் போயஸ் இல்லத்தை அரசுடமை ஆக்கியது செல்லாது. 3 வாரங்களுக்குள் இல்லத்தை தீபா மற்றும் தீபக்கிடம் ஒப்படைக்க வேண்டும்’’ என்ற உயர்நீதிமன்ற தீர்ப்பை தான் வரவேற்பதாக, மறைந்த முதல்வர் ஜெயலலிதாவின் அண்ணன் மகள் ஜெ.தீபா புதிய தலைமுறையிடம் தெரிவித்தார்.

முன்னதாக இன்றைய தினம் மறைந்த முதல்வர் ஜெயலலிதாவின் வேதா இல்லத்தை நினைவில்லாமாக மாற்றுவதற்கு நிலம் கையகப்படுத்தும் தமிழக அரசின் நடைமுறைகளை சென்னை உயர் நீதிமன்றம் ரத்து செய்திருந்தது. அத்துடன், ஜெயலலிதா செலுத்தவேண்டிய வருமான வரி பாக்கி ரூ.36,87,23,462 வசூலை வருமான வரித்துறை தனியாகத் தொடங்கலாம் எனவும் உத்தரவிட்டிருந்தார் நீதிபதி.

வேதா நிலையம் வழக்கில் நீதிபதி என்.சேஷசாயி பிறப்பித்த தீர்ப்பில்,“ஒரு சொத்தை கையகப்படுத்தும் முன் சம்பந்தப்பட்டவர்களுக்கு, 60 நாட்களுக்கு முன் தெரியப்படுத்தப்பட வேண்டும் என்ற விதி இந்த விஷயத்தில் அரசால் பின்பற்றப்படவில்லை. ‘வேதா நிலையத்திற்கு யாரும் உரிமைதார்களே இல்லை’ என்ற ரீதியில் அரசு தானே அதிகாரத்தை கையில் எடுத்துள்ளது. தங்கள் கட்சி சார்ந்த தலைவரை கட்சி நிர்வாகிகள் கொளரவிப்பதை புரிந்துகொள்ள முடிகிறது. ஆனால் இந்த வழக்கில் அரசியல் தலைமையையும், சொத்தின் உரிமையையும் பிரித்துபார்க்க அவர்கள் தவறிவிட்டார்கள்.

மேலும் உரிய விதிகளை பின்பற்றாமல், வேதா இல்லம் கையகப்படுத்தப்பட்டுள்ளது. இப்படி வேதா இல்லத்தை அரசுடமையாக்கியது செல்லாது. அதற்காக பிறப்பிக்கப்பட்ட அரசாணை ரத்து செய்யப்படுகிறது. மேலும் 3 வாரத்தில் போயஸ் தோட்ட இல்லத்தை வாரிசுதாரர்களிடம் ஒப்படைக்கவும்” என்று இருந்தது.

இந்த தீர்ப்பு குறித்து நம்மிடையே பேசிய ஜெ.தீபா, “நியாயமான நேர்மையான இந்த தீர்ப்பை மகிழ்வுடன் வரவேற்கிறோம். இது நாங்கள் எதிர்பார்க்காத தீர்ப்பு. இவ்வளவு விரைவாக இப்படி ஒரு தீர்ப்பு கிடைக்குமென உண்மையிலேயே நாங்கள் நினைக்கவில்லை. கடும் போராட்டத்திற்கு பின்னர் தான் இத்தீர்ப்பை அடைய முடியும் என நினைத்தோம். அதிமுக இத்தீர்ப்பிற்கு மேல் முறையிட்டுக்கு செல்ல முடியாது. மாநில அரசு செல்ல முடியும். திமுக அரசு மேல்முறையீட்டு செல்லாது என எதிர்பார்க்கிறோம்.

3 வாரங்களுக்குள் கண்டிப்பாக போயஸ் வீட்டிற்குள் செல்ல முடியும் என நாங்கள் நினைக்கவில்லை. வருமான வரி உள்ளிட்ட சில வரிகள் செலுத்தி முடிக்க வேண்டியிருக்கும். சட்டரீதியான இன்னும் சில விஷயங்களை செய்து முடித்த பின்னரே வீட்டுக்கு செல்ல முடியும். அதற்கான காலம் எடுக்கும். தீபக்கிடம் தீர்ப்பு குறித்து பேசினேன். அவரும் மகிழ்ச்சியாக இருக்கிறார்” என்றார் மகிழ்வுடன்.

In his judgment in the Vedha Nilayam case, Judge N. Seshasai said, “The government has not complied with the rule that those involved must be notified 60 days in advance before acquiring a property. The government has taken power on its own, saying ‘no one owns the Veda station’. Can understand party executives honoring their party-based leader. But in this case they failed to separate the political leadership and the ownership of the property.

And without following the proper rules, the Vedha house has been acquired. It is not valid to nationalize the Vedha house like this. The ordinance issued for it is revoked. And hand over the Boise estate to the heirs in 3 weeks. ”

Speaking to us about the verdict, J. Deepa said, “We welcome this just and fair verdict. This is a verdict we did not expect. We do not really think that such a verdict will be available so soon. We thought that this verdict could be achieved only after a hard struggle. AIADMK cannot appeal against the verdict. The state government can go. We expect the DMK government appeal to be invalid.

We do not think Boise can definitely go home in 3 weeks. You may have to pay certain taxes, including income tax. You can only go home after you have done a few more things legal. It will take time. I talked to the fire department about the verdict. He is happy too. ”
