நீதிபதியை விமர்சித்த விவகாரம் - The matter of criticizing the judge

சென்னை உயர்நீதிமன்ற நீதிபதி ஆனந்த் வெங்கடேஷை விமர்சித்த தமிழ்நாடு காங்கிரஸ் கமிட்டி தலைவர் கேஎஸ் அழகிரி மீது நீதிமன்ற அவமதிப்பு நடவடிக்கை எடுக்க வேண்டுமென கோரி நீதிமன்ற பதிவுத்துறையிடம் புகார் அளிக்கப்பட்டுள்ளது.

கடந்த அக்டோபர் 1 ம் தேதி போக்குவரத்து நெரிசலில் சிக்கிய உயர் நீதிமன்ற நீதிபதி ஆனந்த் வெங்கடேஷ், நீதிமன்றத்திற்கு வர 25 நிமிடம் காலதாமதமானது. பொது ஊழியரான தன்னை தடுத்து நிறுத்த யாருக்கும் உரிமை இல்லை என தெரிவித்த நீதிபதி, தனது பணி பாதிக்கப்பட்டதால் அது குறித்து உள்துறை செயலாளர் ஆஜராகி விளக்கம் அளிக்க உத்தரவிட்டிருந்தார். அதன்படி காணொலி காட்சி மூலம் உள்துறை செயலாளர் பிரபாகர் ஆஜராகி வருத்தம் தெரிவித்ததோடு, எதிர்காலத்தில் இதுபோன்ற நிகழ்வு நடைபெறாது என உத்தரவாதம் அளித்ததை ஏற்றுக்கொண்டு, முதலமைச்சர் மற்றும் அமைச்சர்களுக்கு வழங்கப்படும் அதே மரியாதையை நீதிபதிகளுக்கும் அளிக்க வேண்டும் என தெரிவித்தார்.

இதைத் தொடர்ந்து நீதிபதியின் செயல்பாடுகளை விமர்சித்து கே.எஸ். அழகிரி அறிக்கை வெளியிட்டிருந்தார். கே.எஸ் அழகிரியின் அறிக்கை நீதிமன்ற அவமதிப்பு எனவும், நீதிபதி மீது அவதூறு பரப்பும் வகையில் வேண்டுமென்றே உள்நோக்கத்தோடு செயல்பட்டுள்ள அவர்மீது உரிய நடவடிக்கை எடுக்க வேண்டுமெனவும் கோரி தேசிய மக்கள் கட்சி தலைவரும்,வழக்கறிஞருமான எம்.எல் ரவி உயர்நீதிமன்ற பதிவுத்துறைக்கு மின்னஞ்சல் மூலம் புகார் அனுப்பியிருந்தார். பதிவுத்துறைக்கு அனுப்பிய புகார் மீது உரிய நடவடிக்கை எடுக்குமாறு தலைமை நீதிபதி அமர்வில் எம்.எல். ரவி சார்பில் முறையிடப்பட்டது. இதை கவனத்தில் எடுத்துக் கொள்வதாக நீதிபதிகள் தெரிவித்துள்ளனர்.

A complaint has been lodged with the Registrar of Courts seeking contempt of court action against Tamil Nadu Congress Committee Chairman KS Alagiri for criticizing Chennai High Court Judge Anand Venkatesh.

High Court Judge Anand Venkatesh, who was caught in a traffic jam on October 1, was 25 minutes late to appear in court. The judge ruled that no one had the right to detain him as a public servant, and ordered Home Secretary Ajaraki to comment as his work had been affected.

Accordingly, Home Secretary Prabhakar Ajaraki expressed regret over the video and acknowledged the assurance that such an event would not take place in the future and said the judges should be given the same respect as the Chief Minister and Ministers.

Following this, K.S. Alagiri had issued the statement. National People's Party leader and lawyer ML Ravi had lodged an e-mail complaint with the High Court seeking action against KS Alagiri for his statement as contempt of court and for deliberately acting with the intention of spreading slander against the judge.

The Chief Justice directed ML to take appropriate action on the complaint sent to the Registrar. Appealed on behalf of Ravi. The judges said they would take this into account.
