பொது இடங்களில் சிலைகளை அகற்ற உத்தரவு -Order to remove idols in public places

தமிழகம் முழுவதும் பொது இடங்கள் மற்றும் நெடுஞ்சாலையோரம் உள்ள சிலைகளை 3 மாதங்களில் அகற்ற வேண்டும் என்று சென்னை உயர் நீதிமன்றம் உத்தரவிட்டுள்ளது.

வேலூர் மாவட்டம் அரக்கோணம் அருகே உள்ள கண்டிகை என்ற கிராமத்தில் டாக்டர் அம்பேத்கரின் சிலையை புறம்போக்கு நிலத்தில் அமைத்ததாக குற்றச்சாட்டு எழுந்தது. இதையடுத்து இந்த சிலையை அகற்றுவதற்கு தாசில்தார் பிறப்பித்த உத்தரவை எதிர்த்து வழக்கறிஞர் வீரராகவன் என்பவர் வழக்குத் தொடர்ந்திருந்தார்.

இந்நிலையில் இந்த வழக்கு நீதிபதி எஸ்.எம்.சுப்ரமணியம் முன்பாக விசாரணைக்கு வந்தபோது, நெடுஞ்சாலைகள் மற்றும் பொது இடங்களில் உள்ள சிலைகளை அகற்ற வேண்டும் என உயர் நீதிமன்றம் மற்றும் உச்ச நீதிமன்றம் உத்தரவிட்டது. அதன் அடிப்படையில்தான் சிலைகளை அகற்றுவதாகவும், இது தவறில்லை என்றும் தெரிவிக்கப்பட்டது.

இதைத் தொடர்ந்து நீதிபதி பிறப்பித்த உத்தரவில் சட்ட விதிகள் மற்றும் உச்ச நீதிமன்ற தீர்ப்பின் படிதான் அரசு நடவடிக்கை எடுத்திருக்கிறது. இதில் எந்தவித தவறும் இல்லை. எனவே இந்த சிலையை அகற்றியது சரியானதுதான் என்று வழக்கை முடித்துவைத்தனர்.

அதேசமயம் பொது சாலைகள், புறம்போக்கு நிலங்களில் வைக்கப்பட்டுள்ள சிலைகளை 3 மாதத்தில் அடையாளம் கண்டு அவற்றை அகற்ற வேண்டும். அவ்வாறு அகற்றும்போது, பொதுமக்களின் உரிமைகள் பாதிக்கபடாத வகையில் சிலைகளையும் கட்டுமானங்களையும் அகற்ற வேண்டும் என்று உத்தரவு பிறப்பித்துள்ளார்.

குறிப்பாக தலைவர்களின் சிலையை வைப்பதற்காக தலைவர் பூங்கா என்ற ஒரு இடத்தை உருவாக்கி பொது இடங்கள் மற்றும் சாலையோரம் உள்ள சிலைகளை அகற்றி அந்த இடத்தில் வைக்கலாம் என்று தமிழக அரசுக்கு நீதிபதி உத்தரவிட்டுள்ளார். இவற்றை பராமரிக்க ஆகும் செலவுகளை இந்த சிலைகளை பொது இடங்களில் யார் வைத்தார்களோ அவர்களிடமே வசூலிக்க வேண்டுமென்றும் அறிவுறுத்தியுள்ளார்.

இந்த உத்தரவுகளை அமல்படுத்தி 6 மாதம் கழித்து அறிக்கையாக தாக்கல் செய்யவும் தமிழக அரசுக்கு நீதிபதி எஸ்.எம்.சுப்ரமணியம் ஒரு தேதியை குறிப்பிட்டுள்ளார். அரசியல் கட்சிகள் மற்றும் சாதி மதம் மொழி சார்ந்த அமைப்புகள் தங்கள் விருப்பத்திற்கு சிலைகளை அமைத்துக் கொள்வதாக குற்றம்சாட்டிய நீதிபதி, தலைவர்களின் சிலையை வைப்பதற்கு அவர்களுக்கு உரிமை இருந்தாலும், பொது இடங்களில் பொதுமக்களுக்கு இடையூறாக இருக்கக் கூடாது என்பதை நீதிபதி சுட்டிக்காட்டியுள்ளார்.

சமுதாயத்திற்காக தியாகம் செய்கின்ற தலைவர்களை எந்த விதத்திலும் சாதி, மதம் ரீதியாக அடையாளப்படுத்தக் கூடாது என்று அறிவுறுத்திய நீதிபதி, அவர்களை பொது ஜனமாகவே கருதவேண்டும் என்றும் தலைவர்கள் சமுதாயத்திற்கு என்ன சொல்ல முற்பட்டார்களோ அதை பின்பற்ற வேண்டும் என்றும் தெரிவித்த நீதிபதி இந்த வழக்கை முடித்து வைத்தார்.

The Chennai High Court has ordered the removal of idols from public places and roadsides across Tamil Nadu within three months.

It was alleged that the statue of Dr. Ambedkar was erected on an outlying land in the village of Kandikai near Arakkonam in Vellore district. Following this, lawyer Veeragavan was prosecuting against the order issued by Tashildar to remove the statue.

When the case came up for hearing before Judge SM Subramaniam, the High Court and the Supreme Court ordered the removal of idols on highways and public places. It was on that basis that the idols were removed and it was reported that this was not a mistake.

Following this, the government has acted in accordance with the rules of law and the judgment of the Supreme Court in the order issued by the judge. There is nothing wrong with that. They therefore concluded that the removal of the statue was correct.

Whereas the idols placed on public roads and outlying lands should be identified and removed within 3 months. In doing so, he issued an order that the statues and structures should be removed so as not to infringe on the rights of the public.

In particular, the judge ordered the Tamil Nadu government to create a place called the President's Park to house the statues of the leaders and remove the statues from public places and roadsides. He also advised that the cost of maintaining these statues should be borne by those who placed them in public places.

Judge SM Subramaniam has given a date to the Tamil Nadu government to file a report 6 months after the implementation of these orders. The judge accused the political parties and caste-religious-language organizations of setting up idols of their choice and pointed out that while they have the right to place statues of leaders, they should not be a hindrance to the public in public places.

The judge concluded the case by advising that leaders who make sacrifices for the community should not be identified by caste or religion in any way, and that they should be treated as the general public and follow what the leaders have tried to say to the community.
