34 ஆண்டுகளுக்கு முன் மரணமடைந்த அரசு ஊழியரின் மகனுக்கு கருணை அடிப்படையில் வேலை வழங்க தமிழக அரசிற்கு சென்னை உயர்நீதிமன்றம் உத்தரவிட்டுள்ளது.
வருவாய் துறையில் பணியாற்றி வந்த தனது கணவர், 1988ம் ஆண்டு சாலை விபத்தில் பலியானதாக கூறி, கருணை அடிப்படையில் தனக்கு அரசு வேலை வழங்க கோரி, ஜெயங்கொண்டத்தைச் சேர்ந்த ரோசா என்பவர் அரசுக்கு விண்ணப்பித்தார். அதே நேரத்தில் மற்றொரு பெண், அரசு ஊழியரின் மனைவி என கூறி கருணை அடிப்படையில் வேலை வழங்க கோரியதால், சட்டப்பூர்வ மனைவி யார் என நீதிமன்றத்தில் உத்தரவு பெற்று வர அரசு அறிவுறுத்தியது.
இதன்படி, ரோசா, தன்னை சட்டபூர்வ மனைவி என அறிவிக்கக்கோரி 2011ம் ஆண்டு ஜெயங்கொண்டம் மாவட்ட முன்சீப் நீதிமன்றத்தில் தொடர்ந்த வழக்கில் ரோசாவிற்கு சாதகமாக 2013ம் ஆண்டும் தீர்ப்பு வந்தது. இதையடுத்து, தன் மகன் பிரபாகரனுக்கு கருணை அடிப்படையில் வேலை வழங்க கோரி சென்னை உயர் நீதிமன்றத்தில் வழக்கு தொடர்ந்தார். ஆனால், 30 ஆண்டுகளுக்கு பின் விண்ணப்பித்துள்ளதாக கூறி, வழக்கை தள்ளுபடி செய்து உயர் நீதிமன்றம் உத்தரவிட்டது.
இதை எதிர்த்து ரோசா மற்றும் பிரபாகரன் தாக்கல் செய்த வழக்கை விசாரித்த நீதிபதி வைத்தியநாதன் மற்றும் நீதிபதி நக்கீரன் அமர்வு, இத்தனை ஆண்டுகள் தாமததிற்கு மனுதாரரையோ அல்லது அரசையோ குறைக்கூற முடியாது என்றும், உரிமையியல் நீதிமன்றத்தில் நிலுவையில் இருந்ததே இந்த தாமதத்திற்கு காரணம் என்றும், அதனால் பிராபகரனுக்கு கருணை அடிப்படையில் பணி வழங்க பரிசீலிக்க வேண்டும் என அரசுக்கு உத்தரவிட்டனர்.
மேலும், தனி நீதிபதியின் உத்தரவை ரத்து செய்தும், பிரபாகரனுக்கு தகுதிக்கேற்ப 3 மாதத்தில் அரசு வேலை வழங்க வேண்டும் என்றும் இந்த உத்தரவு என்பது ஒரு முன்மாதிரியாக கருதக்கூடாது ஏனெனில் இந்த உத்தரவு இவருக்கு மட்டும் தான் பொருந்தும் என்று தெரிவித்தனர்.

The Chennai High Court has ordered the Tamil Nadu government to provide compassionate work to the son of a civil servant who died 34 years ago.
Rosa, a native of Jayangonda, applied to the government for a government job, claiming that her husband, who had worked in the revenue department, had been killed in a road accident in 1988. At the same time another woman, claiming to be the wife of a civil servant, asked for a job on compassionate grounds and the government advised her to seek an order in court as to who the legal wife was.
Accordingly, Rosa was acquitted in 2013 in a case pending in the Jayankondam District Muncipal Court in 2011 seeking to declare herself a legal wife. Following this, he filed a case in the Chennai High Court seeking to grant his son Prabhakaran a job on compassionate grounds. However, the High Court dismissed the case, saying it had applied 30 years later.
Judge Vaithiyanathan and Justice Nakkeeran, who heard the case filed by Rosa and Prabhakaran against this, said that neither the petitioner nor the state could be blamed for the delay for so many years and that the reason for the delay was due to the fact that it was pending in the court of law and therefore the government should consider granting the job to Prabhakaran on compassionate grounds.
They also said that the order of the special judge should be revoked and Prabhakaran should be given a government job within 3 months as per his qualification and this order should not be considered as a precedent as it only applies to him.
