பாலியல் புகார் வழக்கு: வேறுமாநிலத்திற்கு மாற்றக்கோரிய முன்னாள் சிறப்பு டிஜிபி மனு தள்ளுபடி-Sexual harassment case: Former Special DGP's petition seeking transfer to another state dismissed

பெண் ஐபிஎஸ் அதிகாரி கொடுத்த பாலியல் புகார் வழக்கை தமிழகத்தில் இருந்து வேறு மாநிலத்திற்கு மாற்ற வேண்டும் என முன்னாள் சிறப்பு டிஜிபி  தொடர்ந்த வழக்கை உச்ச நீதிமன்றம் தள்ளுபடி செய்துள்ளது.

தனக்கு எதிரான பாலியல் குற்றச்சாட்டு வழக்குகளை தமிழகத்திற்கு வெளியே விசாரணைக்கு மாற்ற வேண்டுமென முன்னாள் சிறப்பு டிஜிபி  உச்ச நீதிமன்றத்தில் மனுத் தாக்கல் செய்திருந்தார். தன் மீதான பாலியல் வழக்கில் நியாயமான முறையில் விசாரணை நடக்கவில்லை என்றும், இந்த வழக்கை ஆந்திர மாநிலம் நெல்லூருக்கு மாற்ற வேண்டும்  என்றும்,  சம்பந்தப்பட்ட அதிகார வரம்பில் இல்லாத விழுப்புரம் மாவட்ட குற்றவியல் நடுவர் நீதிமன்றம் வழக்கை விசாரித்து வருகின்றது என்பதால் அதற்கு தடை விதிக்க வேண்டும் என்றும் கோரிக்கை விடுத்திருந்தார்.

தமிழகத்தில் தொடர்ந்து இந்த வழக்கு விசாரணை நடைபெற்றால் ஒருதலைபட்சமாக இருக்கும் என்றும் தனது தரப்பு வாதங்களை முழுமையாக எடுத்துச் செல்லும் வாய்ப்பு இருக்காது எனவும்  மனுவில் குறிப்பிட்டிருந்தார். இந்த மனு மீது  உச்சநீதிமன்ற நீதிபதி யு யு லலித், ரவீர்ந்தர பாட் அமர்வில் விசாரணை நடைபெற்றது. அப்போது முன்னாள் சிறப்பு டிஜிபி சார்பில் ஆஜரான மூத்த வழக்கறிஞர் முகுல் ரோத்தகி இந்த விவகாரத்தில் நாமக்கல் உளுந்தூர்பேட்டை மற்றும் விழுப்புரம் ஆகிய மூன்று மாவட்டங்களும் சம்பந்தப்பட்டிருக்கக் கூடிய நிலையில் விழுப்புரத்தில் மட்டும் வழக்கின் விசாரணை நடத்துவது என்பது அதன் அதிகார வரம்பிற்கு மீறியது எனவே இதனை வேறு மாநிலத்திற்கு மாற்ற வேண்டும் எனக் கோரிக்கை வைத்தார்.

ஆனால் வேறு மாநிலத்திற்கு மாற்ற வேண்டும் என அவர் வைத்த கோரிக்கையில் எந்தவிதமான முகாந்திரமும் இருப்பதாக தங்களுக்கு தெரியவில்லை எனக் கூறிய நீதிபதிகள் மனுக்களை தள்ளுபடி செய்வதாக உத்தரவிட்டனர். அப்போது குறுக்கிட்ட முகுல் ரோத்தகி வழக்கின் விசாரணையை சென்னைக்காவது மாற்ற வேண்டுமென கோரிக்கை வைத்தார். அது தொடர்பாக தாங்கள் எந்த விதமான உத்தரவையும் பிறப்பிக்க விரும்பவில்லை என்றும், தேவைப்படும் பட்சத்தில் மனுதாரர் சென்னை உயர் நீதிமன்றத்தை இதற்காக நாடலாம் என்று இது தொடர்பாக நிலுவையில் இருந்த அனைத்து மனுக்களையும் தள்ளுபடி செய்து உத்தரவிட்டனர்.

முன்னதாக தனக்கு எதிரான இந்த பாலியல் வழக்கு விசாரணைக்கு தடை விதிக்க கோரி முன்னாள் சிறப்பு டிஜிபி தாக்கல் செய்த மனு ஏற்கனவே உச்சநீதிமன்றத்தில் தள்ளுபடி செய்யப்பட்டது குறிப்பிடத்தக்கது.

The Supreme Court has dismissed a case filed by a former special DGP seeking transfer of a sexual harassment case filed by a female IPS officer from Tamil Nadu to another state.

The former Special DGP had filed a petition in the Supreme Court seeking transfer of sexual assault cases against him outside Tamil Nadu. He had demanded that the sex case against him not be conducted in a fair manner and that the case be transferred to Nellore, Andhra Pradesh, and that the Villupuram District Criminal Arbitration Court, which is not in the relevant jurisdiction, be restraining the case.

He had stated in the petition that if the case was continued in Tamil Nadu, it would be biased and he would not be able to take his arguments in full. The petition was heard by Supreme Court Judge Yu Yu Lalith at the Ravindra Pat session. Senior Advocate Mukul Rothaki, appearing for the former Special DGP at the time, demanded that the case be transferred to another state as it was beyond its jurisdiction to hold the trial only in Villupuram as the three districts of Namakkal, Ulundurpet and Villupuram could be involved in the case.

But the judges dismissed the petitions, saying they did not know there was any implication in his request to be transferred to another state. Mukul Rothaki then intervened and demanded that the trial of the case be shifted to Chennai. They said they did not want to issue any order in this regard and dismissed all the pending petitions in this regard so that the petitioner could seek redress in the Chennai High Court if necessary.

It is pertinent to note that the petition filed earlier by the former Special DGP seeking an injunction in this sex case against him has already been dismissed in the Supreme Court.
